Immigration check by Landlords

Following up on its announcement in the Queen's Speech that private Landlords will be required to check the immigration status of potential tenants, the Government has now set out its proposals to introduce penalties for Landlords who fail to ensure their tenants are in the UK legally.

 

Landlords who let their properties to illegal migrants without having made the necessary checks will be liable to pay a civil penalty. The penalties will be proportionate depending on whether the Landlord has made a single honest mistake, and can rise up to 3,000 per tenant for Landlords who repeatedly and deliberately break the law.

 

The Government said that Landlords are not expected to be experts in detecting fraud and that unless they accept documents that are readily apparent to an untrained person as being forged or fraudulent, they will have a "statutory excuse" from paying a penalty. Responsibility for completing the checks would normally rest with the Landlord.

 

The Government anticipates the new rules will take effect in early 2014.
